These Terms of Service ("Terms") govern your use of the communication services provided by Digital Depths Mining ("we," "us," or "our").

1. Service Description

Digital Depths Mining provides an automated business development communication platform for automotive dealerships. Our service sends follow-up emails and SMS text messages to customers on behalf of dealerships to assist with vehicle inquiries, appointment scheduling, and customer engagement.

2. Consent to Communications

By providing your contact information to a dealership that uses our platform, and by consenting to receive communications, you agree to receive:

• Automated email messages related to your vehicle inquiry
• Automated SMS/text messages related to your vehicle inquiry (if you confirm consent via text)

SMS Double Opt-In

Before receiving any marketing text messages, you will receive a single consent request message asking you to confirm. You must reply YES or Y to begin receiving SMS follow-up messages. If you do not reply or reply with anything other than YES or Y, you will not receive further text messages from us.

After confirming, you will receive a confirmation message acknowledging your opt-in. This confirmation, along with your reply, is recorded as your documented consent to receive automated text messages from the dealership through our platform.

Message frequency varies based on the follow-up sequence. You may receive up to 8 messages over a 30-day period.

Message and data rates may apply depending on your mobile carrier and plan.

3. Opting In and Opting Out

To opt in to SMS: Reply YES or Y to the initial consent request message.

To opt out of SMS: Reply STOP to any text message at any time. Additional opt-out keywords: CANCEL, UNSUBSCRIBE, QUIT, END

To opt out of email: Click the unsubscribe link in any email.

Opt-out requests are processed immediately. You will receive a confirmation of your opt-out.

4. Help

For assistance with text messages, reply HELP to any message or contact us at the information below.

5. Lead Sources and Consent Obligations

Our dealership clients provide customer contact information from a variety of sources, including but not limited to dealership websites, in-person visits, phone inquiries, and third-party lead providers (such as AutoTrader, CarGurus, TrueCar, Cars.com, and similar services).

Regardless of the source, our dealership clients represent and warrant that:

• All leads uploaded to our platform have been obtained lawfully and with proper consumer consent
• Consent obtained covers automated communications sent by the dealership and its authorized service providers, including Digital Depths Mining
• For SMS/text messaging, prior express written consent has been obtained as required by the Telephone Consumer Protection Act (TCPA)
• For leads sourced from third-party providers, the dealership has verified that the lead provider's consent language authorizes contact through automated platforms and service providers acting on the dealership's behalf
• The dealership maintains records of consent for each lead and can produce them upon request

Digital Depths Mining does not independently verify the consent status of individual leads. The dealership bears full responsibility for ensuring all leads uploaded to the platform meet applicable consent requirements.

6. User Responsibilities

You agree not to:

• Use our communication channels for any unlawful purpose
• Send abusive, threatening, or harassing messages in reply
• Impersonate another person in communications

7. Disclaimer of Warranties

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the reliability, availability, or accuracy of our communications platform.

8. Limitation of Liability

To the fullest extent permitted by law, Digital Depths Mining shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your receipt of or interaction with communications sent through our platform.

9. Privacy

Your use of our service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued receipt of communications after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
